The two-pledge-register problem

Polish law creates two independent pledge registers. The Rejestr Zastawów records private pledges constituted by contract. The Rejestr Zastawów Skarbowych records fiscal pledges imposed by the tax administration. Neither register cross-references the other. Does a clean Rejestr Zastawów certificate mean the IP is unencumbered?

No. A clean Rejestr Zastawów certificate covers only private registered pledges. Fiscal pledges in the Rejestr Zastawów Skarbowych are a separate register and require a separate search.
