Vehicles and equipment pledged as collateral in Poland sit across two separate charge registries, a vehicle history portal, and the companies register. No single query covers all four. A foreign buyer or lender who checks only one source will miss encumbrances that the others hold.

What the collateral check covers

The collateral angle on Polish vehicles and equipment requires four parallel checks. Each check runs against a different authority, under different access rules, and returns different data.

The Rejestr Zastawów, operated by the Ministry of Justice through Centralna Informacja, is the primary civil pledge registry. A DW-1 certificate (search by pledgor) costs 20 zł. A DW-2 certificate (search by subject of pledge) costs 20 zł. A full extract (DW-4) costs 15 zł. These are per-item fees. A fleet of twenty vehicles means twenty separate DW-2 queries at minimum.

The Rejestr Zastawów Skarbowych is a separate system operated by the Ministry of Finance. It records tax pledges — a distinct legal instrument from civil pledges. A basic search by subject is free through e-Urząd Skarbowy. A formal wypis or zaświadczenie costs 50 zł. A clean result in one registry does not clear the asset in the other.

The vehicle history barrier

historiapojazdu.gov.pl provides odometer readings, inspection history, damage records, and a count of previous owners. The portal is free and requires no account. However, access requires three data points simultaneously: the current registration number, the VIN, and the date of first registration.

The date of first registration appears on the dowód rejestracyjny — the vehicle registration document held by the owner. A buyer who does not yet have physical access to that document cannot complete the query independently. This is a deliberate design choice in the system, not a technical limitation.

For vehicles imported into Poland, the history shown begins at the date of Polish registration. Prior history from the country of origin does not appear unless separately sourced.

Company-level checks on the borrower or seller

The Krajowy Rejestr Sądowy (KRS) is free to search and free to view. A certified odpis costs between 30 and 60 PLN. KRS shows the current management board, registered capital, shareholder structure for certain entity types, and filed financial statements via the Repozytorium Dokumentów Finansowych — also free.

The Biała lista (White List of VAT payers), maintained by the Head of KAS at podatki.gov.pl, is free and requires no login. It shows current VAT status, registered bank accounts, and the reasons and dates for any deregistration or reinstatement. A historical check on any past date is available. Payment to a bank account not appearing on this list creates joint VAT liability for the payer under Polish tax law.

Insolvency and restructuring status

The Krajowy Rejestr Zadłużonych (KRZ) at krz.ms.gov.pl is public, free, and requires no login. Search runs by NIP, KRS number, PESEL, or case signature. KRZ replaced the former Rejestr Dłużników Niewypłacalnych and the Monitor Sądowy i Gospodarczy (MSiG) as the primary publication channel for insolvency and restructuring announcements from 1 December 2021 onward.

MSiG remains searchable at wyszukiwarka-msig.ms.gov.pl. Its archive runs from 1996. Announcements published before December 2021 are in MSiG, not KRZ. A check of both systems is required for any entity with operating history predating December 2021.

The limit of what the sources allow

The vehicle history portal does not disclose the owner's name. It returns a count of previous registered keepers, not their identities. The connection between a specific vehicle and a specific legal entity must be established through a different route — typically through the Rejestr Zastawów DW-2 query by subject, which does name the pledgor.

KRZ contains only proceedings opened from 1 December 2021. A company with an insolvency proceeding closed before that date will show no record in KRZ. A clean KRZ result is not a clean insolvency history. The MSiG archive must be checked separately for the pre-December 2021 period.

Neither registry shows informal encumbrances: retention-of-title clauses in supply contracts, undisclosed leasing arrangements, or contractual pledges not yet registered. The registered picture and the contractual picture may differ. The sources establish what has been formally recorded. They do not establish what has not been recorded.

Frequently asked questions

Can the pledge registry be searched without knowing the VIN?

Yes. The Rejestr Zastawów DW-2 search runs by subject description, which may include the registration number alone. The VIN is not required for the pledge registry query. It is required only for the historiapojazdu.gov.pl vehicle history portal.

Does a clean Rejestr Zastawów result confirm the asset is unencumbered?

No. The civil pledge registry and the tax pledge registry are separate systems. A clean result in one does not clear the other. Both must be checked. Neither covers unregistered contractual encumbrances.

What if the company has been operating for less than a year?

Financial statements may not yet be filed. KRS shows the registration date. If no statements appear in the Repozytorium Dokumentów Finansowych, the report notes the absence and states the filing deadline that applies under Polish accounting law.

Is the beneficial ownership register (CRBR) publicly accessible?

CRBR is open, free, and requires no account. It shows the declared beneficial owner. The declaration is made by the company itself. The report notes the declared beneficial owner and identifies any discrepancy between the CRBR entry and the KRS shareholder structure.

How long does the report take?

Signal and Standard reports are delivered within five business days of receipt of the required asset identifiers. Extended reports require up to ten business days. Turnaround depends on the completeness of the identifiers provided at the time of instruction.
