What the collateral angle requires

Insolvency proceedings in Poland directly affect collateral in two ways. First, an automatic stay applies from the moment proceedings are opened: enforcement actions by individual creditors are suspended. How proceedings are opened and recorded

The insolvency register for natural persons

KRZ covers both corporate debtors and natural persons, including sole traders (jednoosobowa działalność gospodarcza). Consumer bankruptcy proceedings for individuals are also recorded. Where the debtor is a natural person who is also the registered owner of the collateral asset, the same KRZ search applies.

For natural persons, KRZ also records debt discharge orders and conditions attached to them. A discharged individual debtor may still appear in KRZ for the duration of the discharge period.

The limit of what the sources allow
