What the collateral angle covers
A collateral-angle report answers one question: what does the asset actually secure, and what already encumbers it? The starting point is the land and mortgage register for real property, or the pledge register for movable assets and receivables. Both are official, state-maintained sources. Both carry a retrieval timestamp that fixes the snapshot in time.
For each encumbrance found, the report states the creditor as recorded, the type of security, the rank where the register discloses it, and the date of entry. Where a register discloses a principal amount, that figure is reproduced exactly. Where it does not, the report describes the mechanism and states that no figure is available from this source.
Corporate ownership of the asset is cross-checked against the National Court Register (KRS). Any insolvency or restructuring proceeding affecting the owner is checked in the National Insolvency Register (KRZ). Both checks are part of every collateral-angle report.
The limit of what the sources allow
The ceiling of what the sources allow is stated before payment, not after delivery. Polish registers are authoritative for what they contain. They are not authoritative for what has not yet been registered. A mortgage signed this morning but not yet entered does not appear in any register today. A pledge created by private agreement and not submitted for registration is invisible to every official source.
The land and mortgage register shows entries in the order they were made. It does not show negotiations in progress, letters of intent, or side agreements that modify a registered charge without a formal amendment. The pledge register covers registered financial pledges; it does not cover civil-law pledges held privately.
Where the chain of ownership passes through a foreign entity, the report reaches the Polish node and states where the chain continues outside Polish registers. That foreign segment is outside the scope of this report unless a separate cross-border instruction is placed.
How the report is structured
Each report follows a fixed sequence. The sequence does not change between instructions; the depth of each section depends on what the registers return.

Source-level classification
Every factual statement in the report carries one of three classifications. This is not a quality grade. It describes the epistemological status of the number or fact.

A lender or buyer reading the report can distinguish, at a glance, which numbers come directly from a register and which do not. The classification is applied statement by statement, not section by section.
Where the sources disagree
Discrepancies between registers are reported as findings, not resolved editorially. If the KRS shows a different owner than the land register, both entries appear in the report with their respective retrieval dates. The discrepancy itself is the result. Explaining why it exists requires a legal review, which is outside the scope of this report.
If an insolvency annotation appears in KRZ but no corresponding notation exists in the land register, both facts are stated. The gap between them is noted. No conclusion is drawn about which record controls.
Delivery and turnaround
The report is delivered as a PDF to the email address provided at the time of instruction. Turnaround depends on the complexity of the encumbrance schedule and the number of registers consulted. A straightforward single-asset instruction with one registered owner is typically completed faster than a multi-parcel instruction with a chain of corporate owners. The analytics desk confirms a specific turnaround at the time of instruction.
The report reflects the state of each register at the retrieval date stamped on each section. It does not update automatically. If the instruction is placed to support a transaction with a later closing date, a refresh can be requested at closing. That refresh is a separate instruction.

Does the report constitute legal advice?

What if the asset has no encumbrances?
A clean result is stated explicitly: no mortgage entries in section IV, no pledge registrations found, no insolvency proceedings recorded as of the retrieval date. A negative finding is a finding. It appears in the report with the same source attribution as a positive one.
What happens if the register is temporarily unavailable?
Polish electronic registers experience scheduled and unscheduled maintenance. If a register is unavailable during the retrieval window, the report notes the gap and the retrieval is reattempted. The report is not delivered until all named registers have returned a result or the unavailability is documented and agreed with the client.
