Księgi Wieczyste is the Polish land and mortgage register. It records ownership, encumbrances, and priority of charges over real property. A foreign buyer or lender cannot establish collateral value without reading it — but the register requires a book number to open, and that number is not searchable by name.

Access cost
Free of charge. No registration required to read a known book.
Access condition
Book number (numer KW) required. Name-based search is prohibited for private parties.
What it does not show
Pledges on movables, fiscal liens, and insolvency proceedings — each held in a separate register.
Path to the number
Ewidencja gruntów i budynków (land cadastre) links a plot identifier to a KW number. This step requires a separate query.

Why the book number is the first obstacle

Polish law prohibits name-based searches in Księgi Wieczyste for private applicants. The register is public and free — but only once the book number is known. A foreign buyer who holds only the seller's name and an approximate address cannot open the register directly.

The standard path runs through the land cadastre: ewidencja gruntów i budynków. A plot identifier (działka) links to a KW number. That cadastre is maintained at the powiat (district) level. Access rules vary by powiat. Some districts provide online lookup; others require an in-person or written request with a declared purpose.

Once the KW number is confirmed, the full register is readable at ekw.ms.gov.pl at no charge. The record is structured in four departments: ownership (Dział II), mortgage and charge encumbrances (Dział IV), other encumbrances and rights (Dział III), and property description (Dział I).

What Dział IV shows — and what it does not

Dział IV lists mortgages (hipoteki) registered against the property. Each entry states the creditor, the amount, currency, and priority rank. Multiple mortgages appear in order of registration date, which determines enforcement priority.

Dział IV does not capture two categories of encumbrance that materially affect collateral value. First, registered pledges (zastawy rejestrowe) on movables and receivables are held in the Rejestr Zastawów, administered by the Ministry of Justice. Second, fiscal pledges (zastawy skarbowe) securing tax liabilities are held in the Rejestr Zastawów Skarbowych, administered by the Ministry of Finance. Neither appears in Księgi Wieczyste.

The seller's corporate structure and financial position

Commercial property in Poland is typically held in a spółka z ograniczoną odpowiedzialnością (sp. z o.o.) or spółka akcyjna (S.A.). The KRS discloses company registration, directors, share structure, and filed documents. Access is free at krs.ms.gov.pl.

Filed financial statements are available through the Repozytorium Dokumentów Finansowych, also free of charge. The repository holds accounts filed since the obligation applied. Coverage and completeness depend on the entity's filing history — gaps are themselves informative.

VAT status and registered bank accounts are confirmed via the Biała Lista at podatki.gov.pl. The list shows current status, account numbers declared to the tax authority, and the history of exclusions and reinstatements with dates. A payment made to an account not on the list triggers joint VAT liability for the payer — this is a direct commercial risk, not a procedural point.

Insolvency: what KRZ shows and where it stops

The Krajowy Rejestr Zadłużonych (KRZ) at krz.ms.gov.pl is publicly searchable by NIP, KRS number, or PESEL. No login is required. It covers bankruptcy and restructuring proceedings opened from 1 December 2021.

Proceedings opened before that date were published in the Monitor Sądowy i Gospodarczy (MSiG). The MSiG archive is searchable at wyszukiwarka-msig.ms.gov.pl, free of charge, from 1996. A negative result in KRZ alone does not confirm the absence of an earlier proceeding. Both registers must be checked.

Neither register shows the full procedural file. They confirm that a proceeding exists (or does not), the type, and the date opened. The content of the file — creditor lists, asset schedules, administrator reports — requires a separate application to the court.

CRBR — beneficial ownership

The Centralny Rejestr Beneficjentów Rzeczywistych (CRBR) is publicly accessible at crbr.podatki.gov.pl, free of charge, without an account. It discloses the declared beneficial owner of Polish legal entities.

The register shows what the entity has declared. It does not verify the declaration against underlying documentation. Where the declared beneficiary is itself a foreign entity, the chain stops at the Polish level. Cross-border ownership structures require separate company register queries in each relevant jurisdiction.

The limit of what the sources allow

Księgi Wieczyste shows mortgages registered against the property. It does not show pledges on movables, fiscal liens, or insolvency proceedings. A collateral assessment that reads only the land register is incomplete by design — the remaining encumbrances live in three separate systems.

The KRZ insolvency register covers proceedings from December 2021. Earlier proceedings require a separate MSiG search. A clean KRZ result does not close the question. The CRBR shows a declared beneficial owner, not a verified one. Where the declared owner is a foreign entity, the chain is not traceable through Polish registers alone.

The cadastre path to the KW number depends on powiat-level access rules. In some districts the lookup is online; in others it requires a written request with a declared purpose and a processing period. The time cost of this step varies and is not predictable from outside Poland without prior contact with the relevant office.

Where the sources disagree

The KRS share structure and the CRBR beneficial owner declaration are filed independently. They may reflect different moments in time or different interpretations of control. A discrepancy between the two is itself a finding — it does not resolve automatically and requires explanation from the entity.

Filed financial statements in the Repozytorium may show assets at book value. The KW register shows the mortgage amount. Where the mortgage exceeds the declared book value of the property, the gap is a collateral risk that the register alone does not explain.

Frequently asked questions

Can a foreign party search Księgi Wieczyste by the seller's name?

No. Polish law restricts name-based searches to specific categories of applicants. The path for a foreign party runs through the cadastre: plot identifier first, then KW number, then the register. This is the standard route and adds a step that requires local knowledge of which powiat office holds the relevant record.

Does a clean mortgage register mean the property is unencumbered?

No. Dział IV of Księgi Wieczyste records mortgages. Registered pledges on movables and receivables are in the Rejestr Zastawów. Fiscal pledges are in the Rejestr Zastawów Skarbowych. A property can carry no registered mortgage and still be subject to a fiscal lien that takes priority in enforcement. All three registers are required for a complete encumbrance picture.

Is the KRZ insolvency register complete?

KRZ covers proceedings opened from 1 December 2021. Proceedings opened before that date were published in the MSiG. Both must be searched. A negative result in KRZ alone does not confirm absence of insolvency history.

What does the CRBR actually confirm?

It confirms what the entity has declared as its beneficial owner. The declaration is not independently verified by the register. Where the declared owner is a foreign company, the Polish register does not show what lies behind that company. Cross-border tracing requires additional queries in the relevant jurisdiction.

Are these registers free to access?

Most are. EKW, KRS, KRZ, CRBR, Biała Lista, and the Repozytorium Dokumentów Finansowych are all free and require no login. The Rejestr Zastawów charges per certificate (20 PLN per DW-1 or DW-2 query; 15 PLN for a DW-4 extract). The Rejestr Zastawów Skarbowych charges 50 PLN for a formal certificate. What the report fee covers is the path: identifying the correct book number, knowing which registers are relevant to this asset type, extracting records in Polish, and presenting the result in structured English.
