An enforcement entry on a Polish register is not a final judgment on value. It is a dated, sourced fact that changes the collateral picture immediately. This page describes what official registers show when such an entry appears, which sources carry it, and where the chain of verifiable facts ends.

What the entry shows
A notice that enforcement proceedings have been initiated against the debtor or asset. Source: Krajowy Rejestr Zadłużonych (KRZ) · verified 2026-06-01
What it does not show
The outstanding balance at the moment of inquiry, the creditor's actual recovery position, or whether prior charges rank above the enforcement claimant.
Condition of access
KRZ is publicly searchable. A declared legitimate interest is required to obtain certain debtor-level details beyond the public extract.
Scope limitation
An absence of entry in KRZ does not exclude a filed application that has not yet been registered. Processing delays exist.

What an enforcement entry means for collateral assessment

When enforcement proceedings are noted on a Polish register, the collateral picture shifts in three directions. First, the encumbered asset may be subject to a statutory enforcement lien that ranks ahead of contractual security. Second, the debtor's ability to dispose of the asset freely is curtailed from the date of the entry. Third, any lender relying on that asset as security must account for the enforcement creditor's position in the priority queue.

Polish enforcement law creates a queue. The date of the enforcement attachment determines rank among competing enforcement creditors. Mortgage creditors and pledge holders have a separate statutory priority track. The interaction between enforcement attachments and registered security rights is established from the registers, not from the debtor's representations.

Which registers carry the relevant data

No single register contains the complete picture. The table below maps each register to what it shows, its access condition, and its ceiling.

Register What it shows Access condition Ceiling
Krajowy Rejestr Zadłużonych (KRZ) Enforcement proceedings, insolvency filings, restructuring notices Public search; extended debtor data requires declared legitimate interest Does not show outstanding balance or creditor rank relative to mortgage holders
Księgi Wieczyste (Land and Mortgage Register) Mortgage entries, enforcement annotations on real property, ownership chain Public; searchable by KW number Entries reflect registration date, not filing date; gap between filing and registration creates risk window
Rejestr Zastawów (Pledge Register) Registered pledges on movable assets and receivables Public search by debtor name or asset identifier Does not cover financial collateral arrangements under separate regulations; does not show enforcement attachments
Centralna Informacja KRS (National Court Register) Corporate status, representation, share structure of legal entities Public and free of charge Does not reflect beneficial ownership beyond registered shareholders; UBO data held separately in CRBR
CRBR (Beneficial Ownership Register) Declared ultimate beneficial owners of Polish legal entities Public; access regime subject to verification by local counsel before use in due diligence Data is self-declared; no independent verification mechanism is built into the register

The priority queue: how ranks are established

Priority among competing claims on a Polish asset follows a statutory sequence. Enforcement attachments take their rank from the date the court bailiff (komornik) serves the attachment order. Registered mortgages rank from their entry date in Księgi Wieczyste. Registered pledges rank from entry in Rejestr Zastawów.

The practical consequence: an enforcement entry appearing after a registered mortgage does not automatically subordinate the mortgage. The reverse is also true. Establishing the actual queue requires cross-referencing three registers with their respective entry dates.

Enforcement attachments on bank accounts and receivables do not appear in any of the three property registers. They are served directly on the account-holding bank or the account debtor. This layer of enforcement is not publicly visible from register searches alone.

The limit of what the sources allow

The ceiling of what registers show is stated here before any report is ordered. KRZ shows that proceedings exist and when they were opened. It does not show the current outstanding amount, whether a payment plan is in place, or whether the enforcement has been suspended by court order. Suspension orders are held in court files, not in KRZ.

Księgi Wieczyste shows registered encumbrances. It does not show enforcement attachments on movable assets, bank accounts, or receivables. A property register search with no adverse entries does not mean the debtor's other assets are unencumbered.

No Polish public register shows the total debt load across all enforcement proceedings simultaneously. A debtor may have multiple proceedings opened by different bailiffs. Each is searchable in KRZ, but aggregation requires a structured search across all proceedings linked to the debtor's identifier. A negative result in a single-entry search is not a clean bill of health.

Where the sources disagree

Discrepancies between registers arise in two recurring patterns. First, the KW entry date for a mortgage may differ from the actual filing date by several weeks. During that gap, an enforcement attachment filed after the mortgage application but before its registration may claim an earlier rank. The filing date is held in court records, not in the public KW extract.

Second, KRS may show a company as active while KRZ carries an insolvency filing against the same entity. Both entries are current. The discrepancy reflects the time between filing and the court's formal declaration. A lender relying on KRS status alone without a KRZ cross-check is working from an incomplete picture.

Frequently asked questions

Does an enforcement entry automatically invalidate existing security?

This is a legal question, not a register question. What the registers show is the entry date of each instrument and the identity of each claimant. The legal effect of those entries on existing security is a matter for legal counsel, not for this report.

Can a foreign lender search Polish registers directly?

KRZ and KRS are publicly accessible online. Księgi Wieczyste requires a KW number, which is not always available to a foreign party without prior contact with the seller or court. Rejestr Zastawów requires a Polish-language search interface. The practical barrier is not legal; it is operational: national identifier, language, and system navigation. This report removes that barrier.

How current is the register data?

Each register has its own update cycle. KRZ entries are posted within days of the relevant court order. KW entries reflect the date of registration, which may lag the filing date by weeks. All extracts in this report carry the retrieval date. The report does not represent the position at any date other than the date of retrieval.

Is a clean KRZ result sufficient for collateral clearance?

A clean KRZ result confirms no enforcement or insolvency entry exists at the date of search. It does not confirm the absence of a filed application not yet registered, or the absence of enforcement on assets not covered by KRZ. A complete collateral picture requires all five registers in the table above.
