Before a foreign buyer or lender commits to a Polish commercial property, the ownership chain, encumbrances, and pledge profile of that asset are verifiable through official Polish registers. The Księgi Wieczyste system is the primary source. It is publicly searchable — but only by land register number, not by owner name. Retrieving that number requires a prior step through the cadastral records. This page sets out what each register discloses, what each costs, how long retrieval takes, and where the chain of verifiable facts ends.

Free of charge. No login required. Access requires the KW number — not the owner's name. Source: EKW · verified June 2026.
How to obtain the KW number
The ewidencja gruntów i budynków (land and buildings cadastre) links each plot to its KW number. Access to that record requires the plot identifier (działka number). Source: EKW system documentation · verified June 2026.
What the register does not show
Tax pledges (zastawy skarbowe) and civil pledges (zastawy rejestrowe) are recorded in two separate registers, not in the KW. A clean KW entry does not mean the asset is unencumbered.

What the Księgi Wieczyste entry covers

Each land register (księga wieczysta) is divided into four sections. Dział I records the property description: area, address, and purpose. Dział II identifies the current owner or perpetual usufructuary and the legal basis of that title. Dział III lists encumbrances other than mortgages — easements, rights of way, pre-emption rights, and court injunctions. Dział IV records mortgages, including the creditor, the secured amount, and the currency.

For a foreign lender assessing collateral, Dział IV is the operative section. A mortgage registered there takes statutory priority over unsecured creditors. The entry shows the nominal secured amount, not the outstanding balance. The creditor's name appears, but the underlying loan agreement does not.

Księgi Wieczyste — four sections and collateral relevance
Section Content Collateral relevance
Dział I Property description, area, address, designated use Confirms asset identity and area
Dział II Owner name, legal basis of ownership Confirms who has the right to encumber
Dział III Easements, pre-emption rights, injunctions, other encumbrances Identifies restrictions on transfer or use
Dział IV Mortgages: creditor, secured amount, currency, rank Primary register of secured debt on the asset

The access path: from address to KW number

The EKW system accepts only the KW number as a search parameter. Private individuals cannot search by owner name. This is a deliberate legislative restriction, not a technical gap. The practical consequence: a buyer who knows the address must first obtain the plot identifier (numer działki) from the cadastre, then cross-reference the cadastre to retrieve the KW number, then open the register.

Each step requires the correct identifier from the previous step. For a commercial property with multiple cadastral plots under a single development, each plot carries its own KW number. A partial check — covering only some of the plots — produces an incomplete picture of the mortgage burden.

Pledge registers outside the KW: two separate systems

Polish law maintains two pledge registers that operate independently of the Księgi Wieczyste. Both must be checked before concluding that an asset is free of security interests.

Pledge registers: access and cost
Register Administrator What it covers Access cost
Rejestr Zastawów Ministry of Justice — Centralna Informacja Civil pledges (zastawy rejestrowe) on movables, receivables, and certain rights Certificate DW-1 (by pledgor): 20 PLN · DW-2 (by subject): 20 PLN · Extract DW-4: 15 PLN
Rejestr Zastawów Skarbowych Ministry of Finance — e-Urząd Skarbowy Tax pledges securing unpaid tax liabilities Search: free · Wypis/zaświadczenie: 50 PLN

A clean KW entry in Dział IV confirms no mortgage. It does not confirm the absence of a registered civil pledge or a tax pledge. Both of those registers must be queried separately, using the pledgor's identifier. For a corporate seller, that identifier is the KRS number or NIP.

Seller entity checks: KRS, KRZ, and Biała lista

Collateral value depends on whether the seller can legally transfer the asset. Three registers bear on that question directly.

The Krajowy Rejestr Sądowy (KRS) confirms the seller's legal existence, registered address, share structure, and authorised signatories. It is free and publicly accessible. A certified extract (odpis) costs in the range of 30–60 PLN. The Krajowy Rejestr Zadłużonych (KRZ) records insolvency and restructuring proceedings opened after 1 December 2021. It is free, requires no login, and is searchable by NIP, KRS number, or PESEL. The Biała lista (White List of VAT taxpayers) confirms VAT status, declared bank accounts, and the history of suspensions and reinstatements. It is free, requires no login, and allows retroactive queries by date.

Entity-level registers: access and scope
Register What it shows Cost Material limit
KRS Legal form, ownership, signatories, filed financials (RDF) Free (search and standard view); certified extract 30–60 PLN Filed financials available separately via RDF; not all entities file on time
KRZ Insolvency and restructuring proceedings Free, no login Covers only proceedings from 1 December 2021 onward; earlier proceedings were in MSiG/RDN
Biała lista VAT status, declared bank accounts, suspension/reinstatement history Free, no login Shows declared accounts, not all accounts; does not show tax debt amounts
CRBR Beneficial owners (UBO) as declared by the entity Free, no login Data is self-reported; accuracy depends on compliance; complex structures may not be fully resolved

FREE_SOURCE: what is public and what the report provides

Several of the registers listed above are public and free of charge: EKW, KRS, KRZ, Biała lista, CRBR, and the Rejestr Zastawów Skarbowych search function. This register is public and free of charge. What the report provides is the removed path: locating the correct KW numbers across all cadastral plots, querying each register in the correct sequence, translating the output into English, cross-referencing results across sources, and flagging discrepancies — all delivered as a single documented file with source citations and retrieval dates.

Where the sources disagree

The most common discrepancy in Polish commercial property checks is between the KW entry and the pledge registers. A property may appear unencumbered in Dział IV while a registered civil pledge exists over the equipment or receivables of the operating business at that address. A second common discrepancy arises between the KRS-registered ownership structure and the CRBR beneficial ownership declaration: intermediate holding entities may be listed in one and not resolved in the other.

A third discrepancy involves the KRZ coverage gap. Insolvency proceedings opened before 1 December 2021 were recorded in the Monitor Sądowy i Gospodarczy (MSiG) and the former Rejestr Dłużników Niewypłacalnych. The MSiG archive is searchable from 1996 at no cost. A negative KRZ result alone does not establish that no earlier proceeding exists. Both systems must be queried.

The limit of what the sources allow

The EKW shows the mortgage as registered. It does not show the current outstanding loan balance, any side agreements between the mortgagee and the mortgagor, or whether the mortgage has been called. The secured amount in Dział IV is the ceiling of the registered security, not the live debt figure.

The KRZ covers insolvency proceedings from 1 December 2021. Proceedings before that date require a separate MSiG search. The absence of a KRZ entry does not establish the absence of a pre-2021 proceeding. This report queries both systems and states the result of each separately.

The CRBR shows declared beneficial owners. The declaration is made by the entity's management board. The register does not independently verify the accuracy of the declaration. Where the declared ownership chain is simple and consistent with the KRS, the result is reliable. Where the chain involves foreign holding structures or nominees, the register shows what was declared — not what may be the economic reality. This report identifies the point at which the chain becomes unverifiable from Polish public sources and names the reason.

Frequently asked questions

Can the KW be searched by the seller's name?

No. The EKW system accepts only the KW number. Private individuals and entities cannot search by owner name. The KW number is obtained through the cadastral records, which requires the plot identifier. This is a statutory restriction, not a system limitation.

Does a clean Dział IV confirm the asset is unencumbered?

No. Dział IV records mortgages only. Civil pledges (zastawy rejestrowe) and tax pledges (zastawy skarbowe) are recorded in two separate registers. A Dział IV entry of zero does not establish the absence of pledges. Both pledge registers must be queried using the pledgor's identifier.

What does the KRZ coverage gap mean in practice?

The KRZ records insolvency and restructuring proceedings opened from 1 December 2021. Earlier proceedings were published in the MSiG. A negative KRZ result alone does not exclude a pre-2021 insolvency. The MSiG archive is searchable from 1996 at no cost. Both systems are queried in the Standard and Extended tiers.

How long does the report take?

Signal: three to five business days. Standard: five to seven business days. Extended: eight to twelve business days. Timelines assume the KW number or cadastral plot identifier is provided at the time of instruction. If the plot identifier must be located first, add one to two business days.

Is the CRBR declaration reliable?

The CRBR shows what the entity's management board declared. The register does not independently verify declarations. For simple domestic ownership structures consistent with the KRS, the result is ordinarily reliable. For structures involving foreign holding companies, the report identifies the point at which the chain becomes unverifiable from Polish sources and states the reason.
