When a Polish counterparty offers a mortgage (hipoteka) as security, the collateral value depends on two separate questions: what the property is actually worth, and what already encumbers it. Both questions are answerable from official registers. The answers are not always consistent with each other.

What the sources show
Registered mortgage entries, their rank, currency, and creditor. Source: Księgi Wieczyste (Land and Mortgage Register) · verified 25.07.2026
Access condition
The register is publicly searchable by book number (numer KW). No registration required for read access.
What the sources do not show
The outstanding balance of the secured debt. The register records the mortgage cap, not the amount currently owed.
Ownership chain
The register shows the registered owner. It does not show the beneficial owner or the shareholder structure above the registered entity.

What the land register records — and what it does not

The Polish land and mortgage register (księga wieczysta) is divided into four sections. Section IV records mortgages: each entry states the creditor, the monetary cap, the currency, and the rank. A property may carry multiple mortgages in ranked sequence. The register does not record the current outstanding balance of any mortgage. A mortgage entered at PLN 5 000 000 may secure a debt that has been substantially repaid or one that has not been drawn at all.

Section II records the registered owner. Where the owner is a legal entity, the register shows the entity's name and registered address. It does not show who owns that entity, who controls it, or whether insolvency proceedings have been opened against it. Those facts are held in separate registers.

Section III records other encumbrances and restrictions: easements, rights of pre-emption, enforcement annotations (wzmianki o wszczęciu egzekucji), and interim injunctions. An enforcement annotation in Section III indicates that a bailiff has already attached the property. This annotation precedes any forced sale.

The ownership structure above the registered entity

Where the registered owner is a Polish limited liability company (spółka z ograniczoną odpowiedzialnością), the shareholders and their stakes are recorded in the National Court Register (Krajowy Rejestr Sądowy, KRS). The KRS entry includes the current shareholder list, the management board, and the supervisory board where one exists. Documents filed with the KRS — including the articles of association and, for larger entities, financial statements — are accessible through the same portal.

The KRS shows the direct shareholders. Where a shareholder is itself a legal entity, the KRS does not automatically show who owns that entity. Tracing a multi-level structure requires a separate query for each intermediate entity, in each jurisdiction where that entity is registered. The chain may pass through jurisdictions where ownership information is not publicly accessible.

The Central Register of Beneficial Owners (Centralny Rejestr Beneficjentów Rzeczywistych, CRBR) holds self-declared beneficial ownership data for Polish entities. Access conditions and the completeness of CRBR data are subject to ongoing regulatory change following CJEU case C-37/20. The register is queried as part of the Extended tier; its output is treated as a declared position, not a verified ownership chain.

Insolvency and restructuring status of the collateral provider

A mortgage granted by an entity that is insolvent or in restructuring may be challenged or may rank behind the claims of the insolvency estate. The National Insolvency Register (Krajowy Rejestr Zadłużonych, KRZ) records insolvency and restructuring proceedings opened by Polish courts. A negative result in the KRZ does not confirm that no application has been filed: there is a lag between filing and publication.

The KRZ also records consumer insolvency proceedings against natural persons. Where the registered owner is an individual, this register is part of the standard collateral check.

Registered pledges over movable assets and receivables

The Register of Pledges (Rejestr Zastawów) records statutory pledges over movable property and receivables. Where the collateral package includes assets other than real property — machinery, inventory, receivables — this register is queried separately. A pledge registered here has priority over unregistered claims. The register is searchable by debtor name and PESEL or NIP identifier.

Where the sources disagree

Discrepancies arise in several recurring patterns. The KRS shareholder list may not yet reflect a recently completed share transfer: KRS updates follow registration, and registration follows filing. The land register may not yet reflect a mortgage that has been repaid: deletion requires a formal application by the creditor. A property shown as unencumbered in the land register may carry a mortgage whose deletion has not yet been applied for.

The CRBR beneficial owner declaration may differ from the ownership structure reconstructed from KRS data across multiple levels. Where a discrepancy exists, both positions are recorded and the discrepancy itself is noted as a finding.

The limit of what the sources allow

The land register records the mortgage cap — not the outstanding debt. No official register in Poland publishes the current balance of a registered mortgage. The gap between the registered cap and the actual exposure is not determinable from public sources alone.

The ownership chain terminates at the point where it passes to a jurisdiction that does not publish shareholder data, or where the intermediate entity is a bearer-share structure, a trust, or a foundation with no public register. The Extended report names the point of termination and the reason. It does not reconstruct what lies beyond it.

A negative result in the KRZ confirms only that no proceeding appears in the register at the time of the query. It does not confirm that no application has been filed. There is a lag between filing and publication. The ceiling of what the sources allow is stated before payment.

Frequently asked questions

Can the report confirm that a mortgage has been repaid?

The report records what the land register shows. If the mortgage deletion has not been registered, the entry remains. The report notes the entry and flags that deletion may be pending. Confirmation of repayment requires documentation from the creditor, not the register.

Does the report cover the property value?

No tier includes a valuation. The report establishes the legal position: what is registered, who holds the mortgage, and what other encumbrances exist. Market value is outside the scope of a register-based report.

What if the registered owner is a foreign entity?

The land register records the foreign entity as owner. The KRS will not hold data on that entity. The Extended tier includes a status check in the entity's jurisdiction of registration, limited to jurisdictions where ownership data is publicly accessible. Where it is not, the report names the jurisdiction and states that the chain cannot be traced further from public sources.

How long does the report take?

Signal: delivered within three business days of confirmed instruction. Standard: five business days. Extended: eight business days. Timelines assume that the land register book number (numer KW) and the entity's NIP or KRS number are provided at instruction.

Is the land register free to search?

The electronic land register is publicly searchable without registration at ekw.ms.gov.pl. Access requires the book number (numer KW). This register is public and free of charge. What the report provides is the removed path: identifying the correct book number from the counterparty's NIP or address, reading all four sections in Polish, cross-referencing entries against KRS and KRZ data, and producing a structured English-language summary with source citations and a statement of discrepancies.
