Collateral value in a Polish transaction is not a single number. It is the product of three independent layers: what the asset is worth in an open market, what encumbrances already attach to it, and what enforcement path a secured creditor would actually face. Each layer is readable from official sources. Each has a ceiling.
- What the sources show
- Land and mortgage register entries, including mortgage amount, creditor, and rank. Source: Elektroniczne Księgi Wieczyste (EKW), Ministry of Justice · verified 05.06.2026
- What the sources do not show
- Agreed collateral value between parties; internal bank appraisals; side agreements outside the register.
- Access condition
- EKW is publicly searchable without registration, provided the KW number is known. Source: EKW public portal · verified 05.06.2026
- Key gap
- The KW number is not derived from the address alone. It must be obtained from the seller, the notarial deed, or a paid cadastral extract.
How collateral value is constructed from the register
Polish mortgage law operates on a priority principle. Mortgages rank in the order they were entered in the land and mortgage register. A first-ranking mortgage holder recovers before a second-ranking one. The register shows each mortgage's amount, currency, and creditor. It does not show whether the underlying loan has been repaid or partially discharged unless the creditor has filed a deletion request.
This creates a structural gap. A property may carry a mortgage of PLN 2 million in the register while the actual outstanding balance is PLN 400 000. The register shows the ceiling of the encumbrance, not its current state. Verifying the current balance requires a bank statement or creditor confirmation, which is not a public document.
Pledge registers and movable collateral
Registered pledges over movable assets and receivables are held in the Rejestr Zastawów, administered by the Ministry of Justice. A search by debtor name or PESEL/NIP returns active pledge entries, including the pledged asset description, the amount secured, and the pledge holder. The register is searchable online. There is a fee per search result set by the Ministry of Justice tariff; the current tariff is published on the registry portal and subject to change.
A negative result in the Rejestr Zastawów means no registered pledge was found under that identifier at that date. It does not confirm that no pledge exists: unregistered security arrangements, retention-of-title clauses, and financial collateral under the 2002 Act on Financial Collateral Arrangements fall outside the register entirely.
Valuation: what the register does not contain
No Polish public register contains an agreed or appraised collateral value. Banks commission their own appraisals under the Ustawa o kredycie hipotecznym and internal risk policy. Those appraisals are not filed publicly. The tax authority uses a declared transaction value for stamp duty purposes, but that figure appears only in the notarial deed, not in the land register entry itself.
Cadastral value (wartość katastralna) exists in Polish law in principle but has not been implemented for most property types. It therefore does not function as a reference point for collateral purposes in practice.
Market value must be established independently through a licensed real estate appraiser (rzeczoznawca majątkowy). The methodology is regulated under the Ustawa o gospodarce nieruchomościami. The output is a formal appraisal report (operat szacunkowy). Without one, any figure used as collateral value is an estimate, not a certified number.
Enforcement path and its effect on recoverable value
The value recoverable by a secured creditor in enforcement is not the registered mortgage amount. It is the hammer price at judicial auction, minus enforcement costs and prior-ranking claims. Polish judicial enforcement (egzekucja z nieruchomości) proceeds in two auction rounds. If the first auction fails, the second auction floor is set at two-thirds of the appraised value. If the second auction also fails, the creditor may take the property at that floor price or abandon the proceeding.
Enforcement duration is not fixed by statute. It depends on court workload, debtor conduct, and whether the debtor contests the appraisal. The Krajowy Rejestr Zadłużonych (KRZ) shows whether enforcement proceedings have been opened against a debtor. It does not show their current stage or expected timeline.
Where the sources disagree
The land register entry and the KRZ may present inconsistent pictures. A property may show no mortgage in the land register while the debtor appears in the KRZ under a different enforcement proceeding. Conversely, a mortgage may remain in the land register after the underlying debt was extinguished, if the deletion was never filed. Neither register updates automatically on the basis of the other.
Financial statements filed in the Krajowy Rejestr Sądowy (KRS) may show liabilities not reflected in either the land register or the Rejestr Zastawów. Off-balance-sheet arrangements, guarantee obligations, and intra-group loans appear in notes to the accounts, if at all. Unaudited accounts in the KRS carry no certification of completeness.
The collateral verification sequence
| Step | Source | What it establishes | What it does not establish |
|---|---|---|---|
| 1 | EKW (land and mortgage register) | Registered mortgages, rank, creditor, ceiling amount | Current outstanding balance; unregistered encumbrances |
| 2 | Rejestr Zastawów | Registered pledges over movables and receivables | Unregistered security; financial collateral arrangements |
| 3 | KRZ | Open insolvency and enforcement proceedings | Stage of proceedings; expected timeline; closed proceedings |
| 4 | KRS (financial statements) | Declared liabilities, guarantees if disclosed in notes | Off-balance-sheet items; accuracy of unaudited accounts |
| 5 | Licensed appraisal (operat szacunkowy) | Certified market value | Enforced recovery value after auction haircut and costs |
The limit of what the sources allow
The ceiling of what official sources allow is reached at three points. First, no public register shows the current outstanding balance on a registered mortgage. The register shows the agreed maximum; discharge is a separate filing that creditors do not always make promptly. Second, no public source certifies market value. An operat szacunkowy is a private commissioned document, not a registry output. Third, the KRZ shows that enforcement has been opened; it does not show when it will conclude or what the recovery rate will be.
These three gaps — balance, value, and recovery timeline — are structural. They are not gaps in the search; they are gaps in what the system records publicly. A report from these sources establishes the known encumbrances and the known proceedings. It names the point at which the chain stops and states why.
Unregistered security interests, retention-of-title clauses in supply contracts, and financial collateral arrangements under the 2002 Act are outside every register listed above. Their existence can sometimes be inferred from contract disclosures or auditor notes, but not confirmed from public sources alone.
Frequently asked questions
Can the KW number be found from the property address alone?
Not directly through EKW. The EKW portal requires the KW number as the search key. The number can be found in the notarial deed of purchase, a cadastral extract from the relevant starostwo, or a title search by a licensed notary or adviser who has access to the cadastral system.
Does a clean land register mean the property is unencumbered?
A clean EKW entry means no mortgage or limited right has been registered. It does not rule out unregistered claims, pending but unfiled mortgages, or encumbrances arising by operation of law, such as certain tax liens, which attach without registration.
What is the difference between a registered pledge and a financial collateral arrangement?
A registered pledge (zastaw rejestrowy) is created by agreement and registered in the Rejestr Zastawów. A financial collateral arrangement under the 2002 Act takes effect by transfer or control, without registration. The latter is therefore invisible in the Rejestr Zastawów. It appears, if at all, in contractual disclosures or auditor notes.
How is collateral value different from the mortgage amount in the register?
The mortgage amount is the contractual ceiling of the security, not the current debt and not the asset's market value. A property worth PLN 1 million may carry a PLN 1.5 million mortgage if the lender required over-collateralisation. The register shows the ceiling; market value and outstanding balance are established separately.
